2012 Children's TLC Duck Derby
Rules & Regulations

The Children’s TLC Duck Derby is sponsored by Children’s Therapeutic Learning Center, (“Children’s TLC”, or “Presenter”), 3101 Main Street, Kansas City, Missouri 64111. The Duck Derby shall be open to the legal residents of the United States, who are least 18 years of age (“Entrant”). Children’s TLC is tax-exempt as a Section 501(c)(3) organization.

The Presenter will establish the course for the race. All ducks entered into the Derby will be provided by the Presenter and will remain the property of the Presenter. Once the ducks are dropped, they are on their own; however, manpower may be used to move the ducks in the direction of the finish line at the descrection of the Presenter. Any attempt to free or interfere with any duck is not permitted unless deemed necessary by the Presenter.

A number will be attached to each duck relating to the number on the duck “adoption form.” Multiple duck entries on one adoption form will each be assigned a separate duck number for identification. The person whose name appears on the adoption form corresponding to a winning duck will be awarded the corresponding prize in order of finish. Winners will be announced at the completion of the race and individuals need not be present to win a prize. If necessary, winners will be notified by telephone, email, or certified mail. However, if a winner does not claim his or her prize within 30 days following the race, the Presenter will select an alternate winner though a random drawing of entry numbers. The Presenter will make all decisions and interpretations of the rules and regulations. In case of inclement weather that prevents the launch of the ducks, the Presenter will announce prizes selected through a random drawing.

A purchase or contribution will not increase your odds of winning. By entering the entrants release the Presenter and officers, directors and staff and other related entities from all liability with respect to prizes. By entering, winners consent to the promotional use of their names and likeness without additional compensation.

A list of prizes may be obtained by sending a written request and a self-addressed return envelope to Children’s TLC, attn: Duck Derby Prizes, 3101 Main Street, Kansas City, MO 64111. The Presenter reserves the right, as its sole option, to substitute prizes of comparable value. No cash equivalent will be provided in lieu of the designated prizes. Any and all taxes and similar fees including, but not limited to, applicable licenses and registration fees on any vehicles are the sole responsibility of the winner. Prizes may be subject to certain restrictions.

No purchase necessary in order to enter or win. The Presenter requests a $5 donation per duck adoption to benefit the charitable work of the organization. One free duck adoption entry per person may be obtained during business hours at the Children’s TLC main office. Requests for free entry after 4:00 p.m. on June 20, 2012, or after 10,000 ducks have been adopted will not be honored.

Million Dollar Duck: One Duck in every 3,000 ducks in the duck race will be randomly selected as a potential winning million dollar duck by a third party. The winning duck numbers are selected prior to the race and kept in a sealed security envelope. If the number on the bottom of the first-finishing duck in the race matches one of the pre-selected duck numbers, the adopter of the duck will win the $1,000,000 prize. In the event the number on the bottom of the first-finishing duck does not match one of the pre-selected numbers, the prize will not be awarded. The $1,000,000 prize, if awarded, will be payable in forty (40) equal installments of $25,000 each, without interest. A third party promotion company is under contract with the Presenter for this million dollar duck promotion, and is solely responsible for paying the million dollar prize. In no event shall the Presenter or its sponsors be liable for the million dollar prize. Entrant waives any and all claims against Presenter and its event sponsors as to the million dollar prize. The winner of the prize agrees to allow the Presenter and the third party promotion company to use their name.

The Entry portion of the Duck Adoption form must be completely filled out and delivered or mailed to the Presenter at the address listed in paragraph #1. The Presenter must receive all mail-in entries by 5:00 p.m. on June 22, 2012. Any Duck Adoption forms and funds received through the mail after such time will be considered a donation to Children’s TLC, and not an entry in the Duck Derby. Entrants assume the risk of non-delivery of any entries to the Presenter or an authorized representative of the Presenter. Ducks may be adopted on location the day of the race up to the time the Presenter deems appropriate before the start of the race or until all available ducks have been adopted.

Privacy Notice: When entering into this sweepstakes, you may provide personal information, including, but not necessarily limited to your name and email address. We will only use such personal information to enter you in the Duck Derby race and contact you if you win. Under no circumstances will personal information be shared with any third party not related to the conducting of the sweepstakes. By entering the Duck Derby, you have agreed to permit us to keep and use your information to keep you informed about future events and/or information related to Children’s Therapeutic Learning Center.

The logo and name Derby Duck Race/Turbo Turtle Trek are registered trademarks of GAME an cannot be used or copied without it’s written consent. Sweepstakes void where prohibited by law. All federal, state and local regulations apply. By participating, entrants agree to be bound by these rules. Failure to comply with these or any other Official Rules will result in disqualification. If a prize or prize notification is undeliverable, and/or if a selected winner does not comply with any portion of these Official Rules, such winner will be disqualified and an alternate winner will be selected. Entrants agree that: 1) Presenter shall have right and permission to use (if a winner) entrant’s name and city of residence for advertising, trade and/or other purposes in perpetuity without further compensation (unless prohibited by law); and 2) Presenter, its advertising and promotion agencies, and each of their respective officers, directors, employees, representatives and agents shall have no liability and will be held harmless by entrants for any liability, loss, injury or damage to entrants or any other person or entity relating to this sweepstakes. Any taxes are the sole responsibility of winner. Presenter and its agencies are not responsible for late, lost, or misdirected mail or any printing or technical errors or malfunctions of any kind, by any human error that may occur in the processing of the entries in this Sweepstakes. If for any reason that corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes so that is not capable of being conducted as described in these rules, Presenter shall have the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes. Any person who supplies false information, enters by fraudulent means, or is otherwise determined to be in violation of these rules in an attempt to obtain any prize will forfeit any prize won. Entries become the property of the Sponsor and will not be returned.
